In suits alleging that the U.S. Department of Health and Human Services (HHS) violated the Establishment Clause of the First Amendment by receiving funds from Congress under the Trafficking Victims Protection Act (TVPA) and, then contracting with the United States Conference of Catholic Bishops (USCCB) in 2006 to provide services to trafficking victims, where the contract contained a restriction that no funding be to counsel or provide abortions or contraceptive services and prescriptions to trafficking victims, declaratory judgment for plaintiff is vacated and remanded with instructions to dismiss, where: 1) the 2006 contract expired in October 2011; and 2) no exception applies.
