US v. Maryea, 11-2239

In appeal of conviction for conspiracy to possess with intent to distribute and to unlawfully distribute prescription drugs, judgment is affirmed, where: 1) the district court did not err in denying defendant's motion to dismiss on Speedy Trial Act grounds; 2) the district court did not commit an abuse of discretion by not ordering a second mental health evaluation of defendant's competency; and 3) the government's proof at trial did not establish an impermissible variance that would warrant reversal of defendant's conviction.
