Latin American Music Co. Inc. v. Media Power Group, Inc., 11-2108
In copyright infringement suit for broadcasting songs without a license, summary judgment on twelve songs and jury verdict on remaining songs for defendant are affirmed, where: 1) plaintiff's sufficiency of the evidence challenge is procedurally defaulted; 2) the district court did not abuse its discretion by reviving the issue of ownership of the copyrights and presenting it to the jury; 3) the district court correctly concluded that plaintiff was collaterally estopped from litigating the claims as to the four Corretjer songs; and 4) plaintiff failed to raise the claimed evidentiary error on whether the catalogue printouts should be admissible or sufficient evidence of registration to preclude summary judgment, and thus waived the issue.
