In a copyright infringement action by plaintiff-photographer against defendant-television company, summary judgment for defendant is affirmed, where: 1) no reasonable jury could find "substantial similarity" between defendant's recreated photo and plaintiff's original, and therefore, 2) no jury could properly conclude that defendant's adaptation of the photo infringed plaintiff's copyright in his work.
