Chen v. Holder, 11-1925

Chinese citizens' petition for review of the final orders of the Board of Immigration Appeals (BIA) affirming the denial of their applications for asylum, withholding of removal, and relief under the United Nations Convention Against Torture (CAT), and denying their motion for reconsideration, is denied where: 1) petitioners' procedural claim fails because the BIA did not engage in independent factfinding; 2) the adverse credibility determinations are supported by substantial evidence; and 3) petitioners cannot prevail on a counterpart claim for withholding of removal because they cannot establish the elements of an asylum claim.
