Kenney v. Floyd, 12-1631

In plaintiff's civil rights action against a town, a police officer and a civilian for the death of his son by in a gun battle during a traffic stop, district court's grant of summary judgment in favor of the town and the officer as to all federal claims is affirmed where: 1) evidence is insufficient to show a violation of the deceased's Fourth Amendment rights; and 2) because plaintiff's case against the officer fails, and there was no municipal policy at issue, the claims against the town and the officer's supervisor also fail.
