United States First Circuit
Manganella v. Evanston Ins. Co., 12-1137
In plaintiff's suit against an insurance company for refusing to defend and indemnify against sexual harassment claims from a former employee, district court's grant of a summary judgment in favor of the insurance company is affirmed where plaintiff was not entitled to coverage because, under the doctrine of issue preclusion, a prior arbitration between plaintiff and the purchaser of his business conclusively established that his conduct fell within an exclusion to the policy.
