Perlera-Sola v. Holder, 11-2167
An El Salvadorian citizen's petition for review of BIA's final order of removal is denied where: 1) petitioner has not provided sufficient evidence to establish a well founded fear of future persecution based on his family membership to support his asylum claim; 2) because statutory withholding of removal under INA section 241(b)(3) requires an even greater likelihood of future persecution than asylum, his request for statutory withholding of removal necessarily fails; and 3) petitioner is not eligible for relief under the CAT, as he has set forth no evidence that there is any prospect that he will be "tortured" if he is returned to El Salvador.
