United States First Circuit
US v. Rabbia, 11-1510
Defendant's conviction for being a felon in possession of firearms and ammunition is affirmed where: 1) the Terry stop was justified at its inception, and there is no error in the district court's ruling that it did not constitute an unlawful seizure warranting the suppression of evidence; and 2) the district court properly declined to grant defendant's suppression motion on the ground that evidence had been obtained as a result of a violation of the Fifth Amendment.
