Cruz v. Bristol-Myers Squibb Co., 11-1617
In plaintiffs' suit against their former employer asserting, inter alia, federal claims under ERISA, the Age Discrimination in Employment Act (ADEA), and the Consolidated Omnibus Budget Reconciliation Act, district court's grant of defendants' motion for summary judgment is affirmed where: 1) the district court did not abuse its discretion in severing two of the plaintiffs and dismissing their claims; 2) the district court did not abuse its discretion in declining to certify plaintiffs' suit as a collective action under the ADEA; 3) it was not an abuse of discretion to deny plaintiff's belated motions to amend his complaint; 4) plaintiff has failed to establish a prima facie case of his ADEA, Law 100 and Law 80 claims; 5) plaintiff has failed to exhaust his administrative remedies prior to filing his ERISA claim; and 6) plaintiff's breach of contract claim is without merit.
