United States First Circuit

US v. Marquez, 11-2329

In defendant's conviction for crack cocaine distribution and conspiracy to distribute, district court's imposition of a 121-month sentence is vacated and remanded for resentencing where there is reason to be concerned about treating the second recorded conversation as a sound basis for attributing drugs to defendant on the basis of an extrapolation theory on the facts of this case.
