In a dispute between competing financial institutions, claiming that defendant's use of a confusingly similar mark, "COOP ORIENTAL," violated section 43(a) of the Lanham Act, district court's judgment is: 1) remanded for a determination of whether there is a likelihood of confusion as to the mark and other marks and whether the injunction should be broader; and 2) vacated and remanded to the extent that the district court found that plaintiff did not assert claims of infringement based on defendant's use of the mark and similar marks.
