United States First Circuit
Diaz v. Jiten Hotel Mgmt., Inc., 11-2400
In plaintiff's suit against her former employer alleging various violations of federal and states laws, including the Age Discrimination in Employment Act, the district court's award of fees and costs in favor of the plaintiff after obtaining a favorable jury verdict on one of the six claims in the complaint is:1) affirmed as to its decision to apply a two-thirds reduction to the lodestar as an approximation for the number of hours spent working on four claims that were not viable; and 2) reversed as to the district court's fee reduction as the court improperly focused on plaintiff's rejection of a settlement offer.
