US v. Colon-Rodriguez, 10-2236
Following defendant's conviction for making false statements and defrauding a financial institution in connection with loan applications for a federal aid program, judgment of the district court is: 1) affirmed as to the denial of defendant's motion for a judgment of acquittal on charges for making a false statement on the Farm Service Agency (FSA) loan application on behalf of the farmers; 2) reversed as to the denial of defendant's motion for acquittal on the charge for defrauding a financial institution in violation of 18 U.S.C. section 1344, as the government offered no evidence that the FSA qualified as a "financial institution" at the time of the conduct; and 3) vacated as to the sentence for the defrauding a financial institution conviction, but affirmed in all other respects.
