Felder v. Wetzel, 12-1939
In a Hague Convention case involving a Swiss mother's claims of wrongful detention of her fourteen-year-old daughter, district court's denial of relief and dismissal of the case based on its reading of the various orders of the Swiss authorities is vacated and remanded where: 1) the order had a far more limited scope and the federal court is required under the Convention to hear the case, and 2) because the mother has custody rights under the Convention, this issue is not open on remand.
