McGair v. Am. Bankers Ins. Co. of Florida, 11-2179
In a dispute over the scope of a flood insurance policy issued pursuant to the National Flood Insurance Program (NFIP), a federal program under which private insurers issue and administer standardized flood insurance policies and all claims are paid by the government, the district court's judgment in favor of the insurer is affirmed where homeowner-plaintiffs: 1) allege only that there is an ambiguity as to whether the contents of their basement were covered by their policy; and 2) do not allege that the insurer acted outside the scope of its obligations under the NFIP, and thus they may not escape the rules requiring strict construction of the standard flood insurance policy.
