US v. Symonevich, 11-1236

In a conviction of defendant for conspiracy to distribute and possession with the intent to distribute cocaine and heroin, district court's judgment is affirmed where: 1) as a passenger in the vehicle, defendant did not have a reasonable expectation of privacy in the space below the passenger seat from which the heroin was found; 2) defendant's evidentiary challenges are meritless; 3) evidence was sufficient for a rational jury to conclude that each element of the conspiracy to distribute had been proves beyond a reasonable doubt; and 4) the district court's conspiracy instruction to the jury was accurate and adequate.
