United States First Circuit

US v. Crooker, 10-2372

In a conviction of defendant for possession of marijuana, district court's denial of a motion to suppress statements and evidence found during a search of his home is affirmed where: 1) the district court did not err in denying defendant's motion to suppress on probable cause grounds; 2) the evidence were properly seized pursuant to the plain view doctrine; 3) because the defendant was not in custody for Miranda purposes, the agents' failure to advise defendant of his Miranda rights was not a constitutional violation.
