Holmes v. Spencer, 09-2431

District court's dismissal of defendant's petition for habeas corpus, challenging his murder conviction and sentence is affirmed in part and remanded as, although defendant's petition was not timely filed under the Antiterrorism and Effective Death Penalty Act's (AEDPA) one-year statute of limitations, there may be grounds for equitable tolling the statute of limitations due to the circumstances surrounding the filing of defendant's Rule 29 Motion.
