Conviction of defendants for mail fraud, highway project fraud, and conspiracy to defraud the government, district court's imposition of below-guidelines sentences of six months of home monitoring, three years of probation, and 1,000 hours of community service is affirmed, as the court did not abuse its discretion in concluding that probationary sentences were appropriate where: 1) the loss amount caused by the crimes was imprecise and did not fairly reflect defendants' culpability; and 2) there was insufficient evidence to conclude that the defendants' conduct made the Big Dig unsafe in any way or that the defendants profited from the offenses.
