In a reinsurance dispute brought by a US company alleging that the Canadian company defendant is obligated to reinsure plaintiff for policies plaintiff issued to certain entities in the early 1980s, the district court's denial of summary judgment to plaintiff and award of summary judgment to defendant is affirmed where since it is plaintiff's burden to prove defendant's reinsurance obligation, which it cannot do, summary judgment for defendant was appropriate.
