Fishman Transducers, Inc. v. Paul, 11-1663
In an action primarily for trademark infringement and false advertising under the Lanham Act, 15 U.S.C. section 1051 et seq. (2006), brought by a manufacturer of acoustic equipment that can be attached to individual musical instruments to provide sound amplification, against parties that marketed and sold guitars wrongly claiming to include plaintiff's acoustic component, the District Court's findings are affirmed where the violations were not willful.
