Starski v. Kirzhnev, 11-1393
In a commercial suit involving a $1.5 billion debt swap between the governments of Vietnam and the Russian Federation, claiming conversion, breach of contract, unjust enrichment, fraud and unfair business practices in violation of Massachusetts' Chapter 93A, Mass. Gen. Laws ch. 93A, section 11, the district court's verdict finding no contract existed is affirmed where the district court: 1) acted within its discretion in excluding evidence; 2) did not abuse its discretion in failing to impose sanctions on defendant for misconduct in stalling the proceedings; and 3) committed harmless error when it dismissed defendant's company from the suit.
