In a putative class action alleging that defendant violated the Driver's Privacy Protection Act (DPPA), 18 U.S.C. sections 2721-25, when it included commercial advertising in mailings to Massachusetts drivers that contained their motor vehicle registration renewal notices, the district court's grant of defendant's motion on the pleadings, based on plaintiff's failure to join the Commonwealth of Massachusetts as an indispensable party, is affirmed where even the district court abused its discretion, there was no violation of the DPPA.
