US v. Franco-Santiago, 10-2247

In a prosecution of a police officer for being a member of an ongoing conspiracy that engaged in five robberies of businesses in violation of the Hobbs Act, conviction is reversed and the case remanded for entry of a judgment of acquittal, where: 1) there was sufficient evidence to convict the defendant of conspiring to commit an August 7, 2002 payroll robbery, but there was insufficient evidence to convict him of agreeing to participate in a broader conspiracy spanning July 2002 through September 2002; and 2) the five-year statute of limitations barred prosecution for the August 7 crime.
