United States First Circuit

US v. Jenkins, 11-1302

In a prosecution for unlawfully possessing a firearm following a felony conviction, the conviction and sentence are affirmed, where: 1) the traffic stop that ultimately resulted in finding the firearm was supported by reasonable suspicion of unlawful conduct, prior to the stop and throughout the ensuing investigation; 2) the search warrant was supported by probable cause; 3) the warrant did not fail to describe the things to be seized with sufficient particularity; and 4) kidnapping under New Mexico’s statute is a crime of violence under the federal sentencing guidelines, so the district court correctly set the defendant's base offense level.
