US ex rel. Jones v. Brigham and Women's Hospital, 10-2301
In a qui tam action under the False Claims Act alleging that the defendants submitted an application to the National Institute on Aging for research on Alzheimer's disease that relied on falsified data, the district court's grant of summary judgment for the defendants is vacated, where: 1) the district court abused its discretion by excluding or failing to consider certain expert testimony; and 2) the district court committed an error of law by failing to consider statements of the parties and experts in a manner required by the summary judgment standard.
