United States First Circuit

D.B. v. Esposito, 10-2184

In a case challenging a developmentally disabled child's individualized education program (IEP), the district court's grant of summary judgment to the school district defendants is affirmed, where: 1) the IEP complied with the Individuals with Disabilities Education Act (IDEA) because it was reasonably calculated to confer a meaningful educational benefit; and 2) the plaintiffs could not prevail on discrimination or retaliation claims under the Rehabilitation Act or the ADA, a retaliation claim under the First Amendment pursuant to 42 USC section 1983, or a reassertion of their IDEA claim and their Rehabilitation Act and ADA discrimination claims pursuant to 42 USC sections 1983 and 1985.
