United States First Circuit
Hasan v. Holder, 10-1656
A petition for review of a BIA decision affirming a removal order is dismissed for lack of jurisdiction insofar as it challenged the denial of cancellation of removal, and denied insofar as it sought review of denial of asylum, withholding of removal, and Convention Against Torture (CAT) relief, where: 1) the petitioner's cancellation of removal claim was simply a disguised challenge to fact finding, with no legal or constitutional grounding; 2) the BIA's decision to affirm the immigration judge (IJ) on asylum and withholding of removal was supported by substantial evidence; and 3) there was substantial support for the findings of the IJ and BIA on the CAT ground.
