United States First Circuit
Companonio v. O'Brien, 09-2428
The district court's denial of a petition for a writ of habeas corpus is affirmed, where: 1) the Massachusetts Supreme Judicial Court did not err in finding that the petitioner was competent to stand trial and assist his attorney, and in its ultimate conclusion that he did not receive ineffective assistance of counsel; and 2) the district court did not abuse its discretion in denying the petitioner's request for an evidentiary hearing on whether he was competent to waive a mental illness defense prior to trial.
