Gomez v. The Stop & Shop Supermarket Co., 11-1665
In a slip-and-fall premises liability case against a self-service supermarket, summary judgment in favor of the supermarket is affirmed, where: 1) no factfinder could have rationally determined that a dangerous condition existed at the time of the plaintiff's fall; and 2) no inference of spoliation of evidence could be drawn.
