US v. General Electric Co., 11-1034

In an appeal from a district court judgment holding the defendant liable under CERCLA for response costs incurred by the EPA in the unfinished cleanup of a Superfund site and from the award to the United States of certain cleanup costs it incurred, the judgment is affirmed in both respects, where: 1) the defendant's actions in relation to the Superfund site rendered it liable for arranging for disposal of a hazardous substance pursuant to 42 USC section 9607(a)(3); and 2) the statute of limitations with respect to claims for certain cleanup costs had not expired, because the instant suit was a "subsequent action" for CERCLA statute of limitations purposes.
