US v. Ortiz-Garcia, 10-2323

Conviction and sentencing of defendant upon a guilty plea of discharging a deadly weapon during a crime of violence are vacated because a waiver of appeal provision in defendant's plea agreement is unenforceable and that the district court's Rule 11 violation constituted plain error where defendant was not informed that the maximum penalty for the crime to which he was pleading guilty was life imprisonment.
