Portugues-Santana v. Rekomdiv International, Inc., 10-2018
In an appeal from a judgment of the district court finding defendants liable for "dolo" (i.e., fraud), judgment is affirmed where the court, pursuant to Rule 408, correctly excluded a settlement agreement at trial for the purpose of arguing a reduction in the damages award, but vacated where the court erred by not considering the agreement in connection with the defendants' post-trial motion for an offset of the damages award.
