Wright v. Marshall, 09-2665
In an appeal from a judgment of the trial court denying defendant's petition for habeas relief, judgment is affirmed where trial counsel was not ineffective because he failed to make two specific arguments when objecting to the admission at trial of the prior grand jury testimony of a key witness and because he failed to request that the jury be instructed to take into account the possibility of mistaken identification in determining guilt beyond a reasonable doubt.
