Donald v. Spencer, 10-1304
In an appeal from a judgment of the district court denying defendant's motion for discovery seeking access to various pieces of physical evidence concerning his convictions for rape, kidnapping, assault and battery with a dangerous weapon, and carjacking, judgment is affirmed where there is no abuse of discretion, and because the AEDPA does not unconstitutionally restricts review to Supreme Court precedent.
