In a securities class-action arising from defendant's recall of a coronary stent system and alleging Sections 10(b) and 20(a), 15 U.S.C. sections 78j(b), 78t(a), and Rule 10-b5, 17 C.F.R. section 240.10b-5, violations, summary judgment in favor of defendants is affirmed where plaintiff failed to produce evidence that would permit a reasonable inference that defendants acted with scienter.
