US v. Luna, 09-2263
Conviction and sentencing of defendant for being a felon in possession of ammunition, 18 U.S.C. section 922(g)(1), assaulting, resisting, opposing, impeding, intimidating, and interfering with a deputized federal officer, 18 U.S.C. section 111, and using and carrying a firearm during and in relation to a crime of violence, U.S.C. section 924(c)(1)(A), are affirmed where defendant's challenges that the district court erred in denying his motion to dismiss the section 111 indictment and in failing to grant his motion for a judgment of acquittal as to the same count, as well as on various evidentiary and sentencing grounds fail.
