United States First Circuit

Wright-Ryan Construction, Inc. v. AIG Commercial Ins. Co., 10-1096

In an insurance dispute involving which of two commercial general liability insurance policies should be considered primary for coverage of a claim arising from an accident at a construction site, summary judgment in favor of defendant is reversed where the plain language of the policies at issue requires a concomitant policy to be treated as excess over the defendant's policy.
