Haggins v. Verizon New England Inc., 10-2196
In an action involving defendant's policy of mandating the use of a monitoring devices by plaintiffs and alleging violations of plaintiffs' privacy rights, Mass. Gen. Laws ch. 214 Section 1B, and rights as third party beneficiaries, summary judgment in favor of defendant is affirmed where: 1) the plaintiff's state-law claims are preempted by the Labor Management Relations Act, 29 U.S.C. section 185(a) and other authority; and 2) because the plaintiffs' third-party beneficiary claim fails as a matter of law.
