State of New York v. Amgen, Inc., 10-1630

In a qui tam action appeal from a Rule 12(b)(6) dismissal of plaintiffs' pendent state and federal False Claims Act causes of action against defendants, 31 U.S.C. section 3729 et seq., judgment of the district court is affirmed in part and reversed in part where, on questions of state law, it properly dismissed the action with respect to the application of the law in one state, but erred in dismissing upon application of the remaining state statutes.
