Pruell v. Caritas Christi, 10-2262
In a class action dispute alleging violations of state labor and wages laws, Mass. Gen. Laws ch. 149 sections 148 and ch. 151 sections 1A and 15, judgment of the district court asserting subject matter jurisdiction and dismissing complaint on the ground that section 301 of the Labor Management Relations Act, 29 U.S.C. section 185, debarred preempted state law claims is reversed and remanded for further proceedings where court failed to address the threshold issue of whether the relevant collective bargaining agreements cover any of the named plaintiffs.
