Adelson v. Hananel, 09-2231
In a dispute arising from a declaratory action to determine rights under an oral contract, judgment of the district declaring that defendant did not hold an option to obtain a twelve percent interest in plaintiff's business enterprise is affirmed where: 1) the court properly asserted personal jurisdiction; 2) any error in assigning the burden of proof was harmless; 3) the court did not abuse its discretion regarding a missing witness; and 4) the court made no factual errors regarding the formation and performance of the contract.
