In a labor and wage dispute arising from a deferred compensation plan, summary judgment in favor of defendant is affirmed where: 1) the plan does not violate the Colorado Wage Claim Act because the statute does not require payment of wages or compensation until such amount is earned, vested, and determinable; 2) the plan does it violate Louisiana labor statute, which requires that employers pay discharged employees the amount then due under the terms of employment; and 3) plaintiffs' common law claims fail.
