US v. Newell, 09-1590
Conviction and sentencing of defendants for conspiracy to defraud the United States, 18 U.S.C. section 371, and the misuse of federal grant and tribal monies, 18 U.S.C. sections 287, 666 and 669, are vacated with respect to the materially false statement count against one co-defendant and remanded for further clarification on restitution order, but otherwise affirmed where defendants' challenges on the grounds of improper federal jurisdiction over internal tribal matters, insufficiency of the evidence, improper jury instructions, and erroneous sentencing fail.
