Frappier v. Countrywide Home Loans, 10-2193
In a diversity dispute arising from a complaint for predatory lending practices with respect to a home mortgage loan, Mass. Gen. Laws ch. 93A, summary judgment in favor of defendant-lender is affirmed where the court properly dismissed: 1) a covenant claim relating to a second mortgage loan; 2) plaintiff's negligence claim in its entirety; and 3) plaintiff's rescission/equitable relief claim, but reversed with respect other claims and a covenant claim insofar as such claim relates only a preceding refinance loan.
