Leavitt v. Correctional Medical Services, Inc., 10-1432

In a Section 1983 complaint alleging deliberate indifference to plaintiff-inmate's medical needs in violation of the Eighth Amendment, judgment of the district court is affirmed where the evidence could not, as a matter of law, establish that the institutional defendants' actions violated plaintiff's rights but reversed where plaintiff established a material dispute as to whether individual defendant acted with deliberate indifference to his medical needs.
