Industrial Communications and Electronics, Inc. v. Slade, 10-1738
In a dispute involving section 704(a) of the Telecommunications Act of 1996, 47 U.S.C. section 332(c)(7), and arising from a consent decree permitting the construction of a cell phone tower such that it obstructs the panoramic view enjoyed by appellants from their property, judgment of the district court is reversed where the appellants have standing to challenge the decree since they are parties to the case and have independent interests threatened by the decree.
