US v. Commonwealth of Massachusetts, 10-1664, 10-1668
In a dispute involving the Coast Guard's authority to promulgate regulations that preempt state environmental law with respect to tank vessels, arising out of an oil spill at Buzzards Bay, judgment of the district court is reversed where agency failed to satisfy its obligations under the National Environmental Policy Act (NEPA), 42 U.S.C. section 4321-4347, resulting in harmless error.
