United States First Circuit

US v. Adams, 10-1588

Sentencing of defendant to a 110-month imprisonment term for being a felon in possession of a firearm, 18 U.S.C section 922(g)(1), is affirmed where district court did not abuse its discretion in rejecting a Criminal History Category V classification of defendant, where the effective date of the elimination of the "recency" point in the Sentencing Guidelines succeeded defendant's sentencing, without retroactive application.
